Welcome to The Jet Estates. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and The Jet Estates Aviation Group AG (“Company,” “we,” “us,” or “our”). By accessing or using our website, mobile application, and related services (collectively, the “Platform”), you agree to comply with and be bound by these Terms.

Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to modify these Terms at any time. All changes are effective immediately when we post them and apply to all access to and use of the Platform thereafter. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.

Definitions

Platform
Refers to the website, applications, and services provided by The Jet Estates Ltd.
Host
Means a User who publishes a Listing for hangar space, aircraft parking, or related aviation real estate services.
Guest
Means a User who requests a booking of a Host’s services. Also referred to as the “Operator”.

Scope of Services

The Jet Estates acts as an intermediary platform connecting individuals or entities seeking to charter aircraft (“Charterers”) with third-party aircraft operators (“Operators”) and aircraft owners. The Jet Estates does not own or operate any aircraft and is not an air carrier. All charter flights are performed by fully licensed and regulated third-party direct air carriers or foreign direct air carriers.

Our services include:

  • Providing a search engine for aircraft availability and pricing estimates.
  • Facilitating the booking process between Charterers and Operators.
  • Managing payments and escrow services for charter flights.
  • Offering concierge and ancillary services related to your travel.

User Accounts

To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. The Jet Estates reserves the right to suspend or terminate your account at any time for any reason, including but not limited to, violation of these Terms or suspected fraudulent activity.

Listings & Content

Hosts are solely responsible for the content of their Listings. When you create a Listing, you certify that the information provided is accurate, complete, and up-to-date. You acknowledge that you have all necessary rights and authority to rent the space described in your Listing.

All listings are subject to our approval process to ensure quality and compliance. We verify ownership and insurance documentation before any listing goes live.

Bookings & Payment

Booking Requests: All booking requests are subject to acceptance by the Operator. The presentation of aircraft on the Platform does not constitute a binding offer. A contract is formed only when the Operator confirms the booking and you receive a confirmation notice.

Pricing: Prices displayed are estimates and may vary based on fuel costs, airport fees, and availability. The final price will be confirmed prior to booking. All prices are in the currency specified (usually USD, EUR, or GBP) and may exclude VAT unless stated otherwise.

Payment Terms: Full payment is typically required to secure a booking, unless otherwise agreed in writing. Payments are processed through secure third-party payment processors or wire transfer.

Cancellations

Cancellation policies vary by Operator and are clearly stated on the booking confirmation. Generally, cancellations made within 72 hours of departure may be subject to a 100% cancellation fee.

Force Majeure events (e.g., weather, mechanical issues, regulatory groundings) may result in flight cancellations without penalty, subject to the Operator’s specific terms of carriage.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE JET ESTATES LTD SHALL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL.

We act solely as an agent for the Operator and Charterer. We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Operator or for any personal injuries, death, property damage, or other damages or expenses resulting from them.

Intellectual Property

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by The Jet Estates Ltd, its licensors, or other providers of such material.

All rights are reserved and unauthorized use is prohibited.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
